This website is operated by LAGADO. You will notice that throughout the website, the following words are used interchangeably: “we”, “us” and “our”, all of which refer to LAGADO. This website, including all the information, tools and services contained within, is available to you, based on your acceptance of all the terms, conditions, policies and notices stated here.

When you visit our website, and/or purchase one of our products, you agree to be bound by the terms and conditions listed below, including all additional terms, notices and policies referred to in this Terms of Service, or in any link mentioned. These Terms of Service apply to all users of our website, including but not limited to: users who are browsers, vendors, customers, merchants, and/or contributors of content. If you do not agree to all the terms and conditions of these Terms of Service, then you may not access our website or use any of our services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to our website will also be subject to these Terms of Service. This page will always contain the most recently updated version of the Terms of Service. We reserve the right to update, change, delete or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page from time to time for any changes, and your continued use of, or access to, our website following the posting of any changes constitutes acceptance of those changes.

CONFIRMATION

As soon as we receive your order, we will send you an electronic invoice of your transaction to the email address you have provided us with. The order confirmation, or the electronic invoice (receipt), also serves as a proof of purchase.

PROMO CODES

We may occasionally offer discounts and promotional codes that may be redeemed once you reach the final stage of the check-out process, or other benefits, subject to any additional terms that we establish in relation to these promotional codes and benefits, and these terms will be identified on a per promotional/benefit code basis (“Promo Codes”). Promo Codes may only be used once per person and only the Promo Codes received by you from official LAGADO communication channels are valid. Promo Codes may:

• not be duplicated, sold, or transferred in any manner, or made available to the general public, unless expressly permitted by us;
• be cancelled by us at any time for any reason without liability to us;
• only be used subject to the specific terms established for each Promo Code;
• not be valid for cash; and
• expire prior to your use.

TAXES

All prices shown on our website are exclusive of VAT, therefore, please note that the check-out process will clearly outline whether or not you are subject to import duties and taxes, in line with applicable legislation of your country of delivery. The total amount of import duties and taxes will be clearly indicated for you in the check-out process, and must be collected by us in order for us to fulfil our legal obligations and for the transaction to be finalized. However, there
are exceptions for selected countries which are restricting us from pre-collecting duties and taxes and you will need to pay these directly when the shipment arrives. Unfortunately, this is out of our hands and mainly concerns the
countries local policies.

PRICING

We reserve the right to change prices, rectify any incorrect prices on all orders as well as final sales. If the price of one or more of our products is incorrect, we reserve the right to cancel the transaction and refund any amount paid and this can be done at any time.

WARRANTY

Our warranty duration for our watches is two years from the date of purchase. This warranty covers manufacturing defects of the watch limited to the movement, case, and crystal only. Our warranty also extends to manufacturing defects of our leather straps, with the exception of wear and tear. To receive a replacement under this warranty, please contact us at info@lagadowatches.com and include your name, address, serial number of the product, order number and a detailed description of the issue, and include in the header “Return under Warranty”.  Please note that the return under the warranty will only be valid if it is accompanied by details of the activated Lagado Warranty Card and proof of the purchase receipt.

Return shipping will be paid by us, however if we cannot find any defects listed above, the product will be sent back to you.

Repair or any replacement will be charged in the following situations, even if it takes place during the warranty term:

• failure or damage caused by improper or reckless use;

• failure or damage caused by improper, unreasonable and unnecessary repair or modification;

• failure or damage caused by fire or water;

• normal wear and tear and aging ( such as minor scratches, a change in the color of the strap and anything that is normally expected to take place as a result of reasonable wear and tear); and

• if the activated Lagado Warranty Card is not submitted along with the watch.

DELIVERY AND CANCELLATIONS

Any brand-new product, in its original packaging, unworn and undamaged can be returned for a full refund within 30 days of delivery. We offer free and easy returns for all orders over 60 USD. Please contact us at info@lagadowatches.com to schedule the return and receive a prepaid return label. For returns under 60 USD, the customer will be responsible for the cost of return shipping.

Once you notify us that you would like a return, we will email you a prepaid return label within 48 hours. Once your return has been received by the warehouse, and provided it complies with our return policy, as stated above, we will refund you by your original payment method. Please note that payments can take up to 7-10 working days to process depending on your bank or payment provider.

Returned items will be credited in full amount. Original shipping and handling fees are non-refundable, except for defective or wrongly shipped items

LIABILITY

To the extent permitted by law, with the exception of damage caused by intent or gross negligence, LAGADO, including its employees, interns, directors, officers, contractors, subcontractors, licensors, subsidiaries, shareholders or agents, exclude all liability and responsibility for any amount or type of loss or damage that may result to you, or a third party (whether based in contract, tort or strict liability and including without limitation, any direct, indirect, punitive, special and consequential damages, or any loss of income, profits, goodwill or data) in connection with our website, products and services in any way, or in connection with the use, inability to use or the results of use of our website, any websites linked to our website or the material on such websites, including but not limited to loss or damage due to viruses that may infect your computer, software, data or other property as a result of your access to, use of, or browsing of our website or your downloading of any material from our website, or any websites linked to our website.

AGE OF CONSENT

By using our website, you represent that you are of legal age in your city, state or country of residency to do so, and you have given us your consent to allow any of your minor dependents to use our website.

INDEMNIFICATION

You agree to indemnify, defend and hold harmless LAGADO and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

TERMINATION

If (1) payment cannot be charged to your payment provider in a timely manner for any reason, (2) you have materially breached any provision of these Terms of Service, and/or (3) we have a legal obligation, we have the right to, immediately and without notice, suspend or terminate our services provided to you, including the use of our website and the deletion of your account.

In the event that we determine, in our sole discretion, that you have breached any provision of these Terms of Service, or have otherwise been involved in inappropriate or illegal conduct, we reserve the right to notify and/or send any content you have provided us with to, and fully cooperate with the law enforcement authorities for further action, and pursue any other action which we deem to be appropriate. If we believe an illegal and suspicious activity is taking place, we reserve the right to refer the issue to, and cooperate with the appropriate legal authorities.

We reserve the right, in our sole discretion, to immediately take any or all of the actions above without any notice or warning to you. You agree that all terminations shall be made in our sole discretion and that we shall not be liable to you, or any third party for enforcing this provision. 

USER CONTENT

Our website may include user generated content from social media applications, such as Instagram. We do not claim any ownership in rights in such content (images, photos and videos etc.) and take no legal responsibility for such content. In case of a violation of copyright, or any other right, please notify us by contacting our customer service.

INTELLECTUAL PROPERTY RIGHTS

All intellectual property rights, such as trademarks and copyright, on our website and in the material published on it are owned by LAGADO, or our subsidiaries or licensors. Any use of our website or its content, including copying or storing such content in whole or part, other than for your own personal and non-commercial use, is prohibited without receiving our expressed permission.

CHANGES TO TERMS OF SERVICE

You can view the most current version of these Terms of Service at any time on this page. In our sole discretion, we reserve the right, to update, amend, delete or replace any part of these Terms of Service by posting these changes on our website. It is your responsibility to check our website periodically for changes and your continued use of, including browsing and accessing our website, following any changes to these Terms of Service constitutes acceptance of these changes.

ENTIRE AGREEMENT

The failure of LAGADO to exercise or enforce any right or provision of these Terms of Service does not constitute a waiver of such a right or provision.

These Terms of Service and any policies posted by us on our website constitute the entire agreement and understanding between you and us, and govern your use of our website, and they supersede any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of these Terms of Service).

SEVERABILITY

In the event that a provision of these Terms of Service is determined to be unlawful, void or unenforceable, such a provision shall nonetheless be enforceable to the extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, and this shall not affect the validity and enforceability of any other remaining provisions.

FORCE MAJEURE

LAGADO shall not be held liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargos, acts of civil disobedience or military authorities, fire, floods, accidents, strikes or shortages of transportation facilities, fuel, energy, labor or materials.

GOVERNING LAW AND JURISDICTION

These Terms of Service and the use of our website shall be governed by and construed in accordance with the laws of Hong Kong, Hong Kong SAR China, subject to our right to prosecute a user at his/her city or country of residence.
